These Terms and Conditions (“Terms”) govern your use of the Website and services provided by Fanime Marketplace (“we,” “us,” or “our”). By accessing or using the Website, you agree to comply with and be bound by these Terms. If you do not agree, you may not use the Website or its services.

“Vendor” refers to anyone selling products or services on the Marketplace.
“Customer” refers to anyone purchasing from the Marketplace.
General Information
Fanime Marketplace is an online marketplace that connects vendors and customers for the purchase and sale of goods. As the marketplace facilitator, Fanime Marketplace provides the platform for vendors to list their products, manage transactions, and receive payments, while customers can browse products and make purchases.
Eligibility
To use our services, you must:
- Be at least 18 years old.
- Provide accurate and complete registration information.
- Accept these Terms and any applicable policies, including our Privacy Policy.
Accounts
- User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- Notify us immediately of unauthorized access or use of your account.
- We reserve the right to terminate accounts violating these Terms.
- Vendor Accounts
- Vendors must register and comply with additional Vendor Terms.
- Vendor payment processing is facilitated through Stripe Connect.
- Vendors must provide accurate information and maintain their Stripe account.
Marketplace Role And Responsibilities
Fanime Marketplace acts as a facilitator connecting buyers and sellers.
We do not own, create, or inspect products sold by Vendors.
Responsibility for transactions lies with the Vendor and Customer.
We are not liable for any disputes or damages arising from sales or interactions.
Payment Processing:
Fanime Marketplace uses Stripe as a payment processor. The marketplace collects the 6% fee and ensures it is transferred to the marketplace account.
Platform Support:
Fanime Marketplace provides the platform for vendors to list their products, collect fees, and facilitate transactions. However, the marketplace is not responsible for individual transactions, refunds, or disputes between vendors and buyers.
Vendor Responsibilities
Vendors are responsible for the following:
- Listing their products, including accurate descriptions, prices, and images.
- Ensuring that products comply with applicable laws and regulations.
- Handle all customer service inquiries, including processing refunds and managing disputes, as the marketplace does not handle these issues. If needed, check out our Dispute Resolution Policy.
- Adhering to everything that is outlined in the Vendor Agreement.
- Pay any Stripe payment processing fees associated with your sales transactions.
- Properly connecting to Stripe for payout processing, adhering to Stripe Connect settings.
- Ensuring your Stripe account is active and up to date.
Compliance: Vendors are responsible for complying with all applicable laws, including sales tax and consumer protection laws. Fanime Marketplace is not responsible for collecting or remitting taxes on behalf of vendors. However, Fanime Marketplace will collect any applicable sales taxes on orders in accordance with applicable law. Please refer to our Tax Policy if needed.
Customer Responsibilities
As a customer, you agree to:
- Provide accurate billing and shipping information.
- Follow the marketplace’s return and refund policies.
- Pay the agreed-upon price for items purchased, including all taxes (as detailed on our Tax Policy Page), shipping costs, and Marketplace fees.
You are responsible for safeguarding your downloads. We cannot guarantee security against unauthorized use after the product has been downloaded.
By purchasing/downloading any digital products, the buyer is granted a personal, non-transferable, and non-commercial license for use. Redistribution, modification, or commercial use without prior approval is prohibited.
Marketplace Fees
Buyer Fee:
By making a purchase on Fanime Marketplace, buyers agree to pay a 6% marketplace fee on the total order amount. This fee is applied at checkout and is clearly shown as a separate charge labeled “Marketplace Fee“. The marketplace fee is non-refundable and is collected by the marketplace for operational and platform support.
Payment Processing Fees:
All payments for purchases made on Fanime Marketplace are processed through Stripe. The marketplace fee is collected directly from the buyer and transferred to the marketplace account upon successful payment.
All payments are processed via Stripe and subject to their terms and conditions.
Prices and availability are subject to change without notice.
Any disputes regarding payments or invoices should be reported to Fanime Marketplace support.
Vendor Commission and Payment
Vendor Payment Structure:
Vendors listed on Fanime Marketplace receive 100% of the proceeds from their product sales, minus the 6% marketplace fee applied to buyers. The marketplace fee is automatically deducted during the checkout process, and the remaining funds are transferred directly to the vendor’s Stripe account.
Vendor Payment via Stripe Direct Charges:
Payments to vendors are processed through Stripe’s Direct Charges system. This means vendors are responsible for handling payment processing fees, including any charges levied by Stripe for transaction processing. Fanime Marketplace does not deduct these fees, and vendors must ensure that their account is set up to handle processing fees accordingly. Vendors are also responsible for handling refunds, chargebacks, and disputes directly with their customers. The marketplace is not responsible for these activities.
Stripe Account Requirements:
Vendors must have an active Stripe account in order to receive payments. It is the vendor’s responsibility to ensure their account is correctly set up and connected to Fanime Marketplace via Stripe Connect. Payments will be made directly to the vendor’s Stripe account after deducting the marketplace fee.
Fee Structure Transparency
Clear Fee Disclosure:
The 6% marketplace fee will always be clearly shown to buyers during the checkout process. This fee is automatically applied to the buyer’s total order and is non-refundable.
Changes to Fee Structure:
Fanime Marketplace reserves the right to change the marketplace fee at any time. Any changes to the fee structure will be communicated to both vendors and buyers in advance. Updated fees will be reflected in the terms of service upon change.
Refunds and Disputes
Refund Policy:
Vendors are responsible for processing any refunds related to their products. If a buyer is eligible for a refund, it is the vendor’s responsibility to issue the refund directly through their Stripe account. The marketplace is not responsible for managing refunds.
Disputes and Chargebacks:
All disputes and chargebacks are handled by the vendor directly with the customer. Since Fanime Marketplace uses Stripe Direct Charges, the responsibility for managing disputes, chargebacks, and any related fees falls to the vendor. The marketplace does not intervene in these cases.
Shipping and Delivery
Vendors are responsible for handling their own shipping. Fanime Marketplace will not be involved in the shipping process, but vendors must ensure timely delivery and offer adequate customer service in case of delivery issues.
Prohibited Activities
Users and Vendors are prohibited from:
- Violating local, national, or international laws.
- Selling illegal, counterfeit, or infringing products.
- Engaging in harassment, fraud, or deceptive practices.
- Circumventing the Marketplace’s fee structure.
- Uploading malicious code or engaging in data theft.
Violations may result in account suspension or termination.
Product Listings
Vendors are solely responsible for:
- The accuracy and legality of their product listings.
- Compliance with intellectual property laws.
- Timely fulfillment of orders.
- All shipping and handling.
- Returns, refunds, and customer inquiries regarding products.
Tax Responsibilities
Tax Collection and Reporting:
Fanime Marketplace is responsible for collecting applicable sales taxes based on the buyer’s location at the time of purchase. This ensures compliance with local tax laws.
Vendor Tax Responsibilities:
Vendors are responsible for managing their own taxes, including income tax, VAT, and any other applicable taxes on their earnings. Fanime Marketplace is not responsible for reporting or remitting taxes on behalf of vendors for their earnings, but will handle applicable sales tax during the checkout process.

Disputes Between Vendors and Customers
Fanime Marketplace does not mediate disputes between Vendors and Customers but may, at its discretion, assist with resolution efforts. For unresolved issues, please read our Dispute Resolution Policy and contact support@fanimemarket.com.
Limitation of Liability
We are not liable for loss or damages resulting from your use of the Website or third-party services, including Stripe.
Vendors and Users agree to hold Fanime Marketplace harmless from claims arising out of their use of the Website.
Fanime Marketplace shall not be held liable for delays, errors, or omissions in processing orders.
Fanime Marketplace shall not be held liable for any damages resulting from improper shipping or handling by vendors.
Our liability, under any circumstance, is limited to the fees paid to us for using our services.
Intellectual Property
The Website’s content and design are protected by copyright laws.
Vendors retain ownership of their product listings, but grant Fanime Marketplace the right to use such content for marketing and promotional purposes.
Vendors retain all ownership and copyright to their uploaded digital files. Purchasers are granted usage rights only for personal use unless otherwise specified by the vendor.
Unauthorized reproduction of the Website’s content is prohibited.
Fanime Marketplace Fan Art Guidelines & Vendor Terms
General Policy
Fanime Market is a marketplace platform dedicated to anime and Japanese pop culture fans and creators. It supports the sale of original fan-made creations as well as officially licensed merchandise such as trading cards, figures, and apparel.
By registering as a vendor, you agree to abide by these guidelines and take full responsibility for the content you upload. We respect the intellectual property rights of copyright holders and require vendors to do the same.
Acceptable Products, Fan Art & Copyright Compliance
Vendors are permitted to sell artwork that falls into the following categories:
✅ Original Creations: Unique, anime-style artwork not directly based on existing copyrighted characters.
✅ Inspired-by Designs: Art influenced by anime themes but without direct character replication.
✅ Parody & Satirical Works: Artwork that significantly transforms original characters for commentary or humor (subject to legal interpretation and jurisdiction).
✅ Licensed Fan Art: If you have a license or permission from the copyright holder, you may sell related artwork. Proof of licensing may be required upon request.
✅ Officially Licensed Products: Reselling of licensed merchandise is allowed as long as the items are authentic and lawfully acquired.
🚫 Prohibited Content
- Direct copies, traces, or replications of copyrighted characters, scenes, or official artwork.
- The use of official anime/manga logos, symbols, or trademarks.
- Selling items that violate the intellectual property rights of companies such as Shueisha, Toei Animation, Kadokawa, Aniplex, Nintendo, or any other rights holder.
- AI-generated artwork using copyrighted characters or elements without permission.
Reselling Licensed and Official Products
Fanime Market permits the resale of legally obtained, officially licensed anime and game merchandise, including trading cards, figures, collectibles, and other media. Sellers are responsible for ensuring that any such products are authentic and lawfully acquired.
Fanime Market does not permit the sale of counterfeit, pirated, or unlicensed replica goods.
All listings must accurately describe the condition and origin of the item, and any claims regarding authenticity must be truthful.
DMCA & Copyright Complaints
If a copyright holder submits a valid Digital Millennium Copyright Act (DMCA) takedown request, Fanime Marketplace will remove the reported content and notify the vendor. Vendors may file a counter-notification if they believe their work does not infringe copyright. Repeat violations may lead to account suspension or permanent removal from the marketplace.
Vendor Responsibility
Vendors must verify that they have the right to sell their artwork. Vendors agree to indemnify Fanime Marketplace against legal claims resulting from copyright violations. Fanime Marketplace reserves the right to remove content or restrict vendor access at its discretion.
Reporting Infringements
If you believe a listing infringes on copyright, please submit a claim via our Copyright Violation Form, including the artwork in question, the original copyrighted material, and proof of ownership.
Policy Updates
Fanime Marketplace reserves the right to update these guidelines at any time. Vendors will be notified of significant changes. By listing artwork on Fanime Marketplace, vendors acknowledge and agree to these terms. Failure to comply may result in removal from the platform.
Termination
We may terminate your account or access to the Website at our discretion, with or without notice, for:
- Breach of these Terms.
- Fraudulent or illegal activity.
- Non-payment of fees.
You may terminate your account at any time by contacting support@fanimemarket.com.
Privacy
All personal information collected is subject to our Privacy Policy, available here. By using our services, you consent to our data practices.
Changes to Terms
Fanime Marketplace reserves the right to update or modify these Terms at any time. Any changes will be posted on this page, with the effective date noted at the top. Your continued use of the Website constitutes acceptance of revised Terms.
Governing Law and Jurisdiction
These Terms are governed by the laws of Canada. Any disputes will be subject to the exclusive jurisdiction of the courts of Alberta.
